Taking action after an elevator injury

Sometimes you have no choice but to use an elevator in order to get from one place to another. Whether you are using an elevator in a shopping mall, office building or in your own apartment building, elevators are a necessity in many people's commute. Like all forms of transport however, there is a risk of accidents when using an elevator.

If you have been injured as the result of an elevator accident or malfunction, it is important to know that you have certain rights, and the owner of the building in which the elevator was in had an obligation to keep you reasonably safe from harm.

Elevator malfunctions

If an elevator free falls, it can cause crippling injuries that can cause lasting effects. If you were injured by a free falling elevator, it is likely that you have suffered a great deal of pain, as well as had to pay significant medical bills. It may be possible to take action against the building the elevator was in or against the repair company responsible for maintaining the elevator.

Emotional injuries

Even if you did not suffer a physical injury from the incident in the elevator, you may have had a traumatic experience, especially if you were stuck for hours. You may be able to gain damages for the emotional impact the experience has had on your life.

If you or a loved one has suffered a physical or an emotional injury due to an incident in an elevator, you may be able to gain back damages, especially if you can prove that negligence caused the incident.
